Terms of Service

These Terms of Service ("Terms") are an agreement between you and CrazyChickenGames ("we", "us" or "our") about your use of Coaster Creator VR (the "Game"), including any alpha, beta or test builds and any updates. By installing, accessing or playing the Game, you agree to these Terms. If you do not agree, do not install or play the Game.

1. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and play the Game on devices you own or control, for your own non-commercial entertainment. The Game is licensed, not sold. We and our licensors keep all rights, title and interest in the Game, including all intellectual property rights, except as expressly granted here.

2. Alpha and test builds

Access to pre-release builds is by invitation only and may be withdrawn at any time. Pre-release builds are unfinished and are provided for testing and feedback. They may contain bugs, crash, lose data, perform poorly, or change or remove features without notice. Unless we give you written permission, you may not share, upload, sell or distribute any pre-release build, or any download link we give you, with anyone else. Screenshots, videos and streams of the Game are welcome.

3. Restrictions

Except where the law does not allow us to forbid it, you may not:

• copy, sell, rent, lease, sublicense or redistribute the Game or any part of it;
• reverse engineer, decompile, disassemble or try to extract the source code or assets of the Game;
• modify the Game or make derivative works based on it, other than the coasters you create while playing;
• remove or alter any copyright, trademark or other notice in the Game;
• use the Game for any unlawful purpose or in breach of these Terms.

4. Your creations

You own the coasters and other content you create in the Game ("Creations"), to the extent you have rights in them. If you share your Creations or send them to us as feedback, you grant us a free, worldwide, non-exclusive license to use, reproduce and display them in connection with developing and promoting the Game. If you send us suggestions or feedback, we may use them without any obligation to you.

5. Health and safety

Virtual reality can cause motion sickness, eye strain, disorientation, dizziness, nausea and, rarely, seizures, and riding a virtual roller coaster can be intense. Read and follow your headset manufacturer's health and safety warnings, including its age requirements. Play in a clear, safe space, take regular breaks, and stop playing straight away if you feel unwell. Do not play while driving, operating machinery, or doing anything that needs your full attention. You play at your own risk.

6. Third-party platforms

Your use of the Game on third-party hardware or platforms, such as Meta Quest or the Meta Horizon Store, is also governed by those parties' own terms. We are not responsible for third-party hardware, software or services.

7. Disclaimer of warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY CONTENT, INCLUDING YOUR CREATIONS, WILL BE PRESERVED.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CRAZYCHICKENGAMES OR ITS MEMBERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE GAME, IF ANY, AND US$10. Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited, so some of the above may not apply to you, and nothing in these Terms limits any rights you have that cannot be waived by law.

9. Termination

These Terms apply until ended by you or us. You may end them at any time by uninstalling the Game. Your license ends automatically if you break these Terms, and we may end your access to pre-release builds at any time. When the license ends, you must stop using the Game and delete all copies of it. Sections 3, 4, 7, 8 and 11 survive termination.

10. Privacy

The Game does not collect or sell any data. See our Privacy Policy for details.

11. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Game. If any part of these Terms is found to be unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. You may not transfer your rights under these Terms; we may transfer ours in connection with the Game.

12. Changes to these Terms

We may update these Terms from time to time, for example when the Game leaves alpha. The effective date at the top of this page shows when they were last changed. If you keep playing after a change, you accept the updated Terms.
